Terms & Conditions for MEGA Gaming Pty Ltd Trading as Neo Arcade Machines – User Agreement.

Please take the time to read these Terms thoroughly, as they set out important information about your rights, responsibilities, and the limitations that may apply to your use of our services.

Definitions

"Services" refers to all offerings provided by MEGA Gaming Pty Ltd trading as Neo Arcade Machines.
"Website" or "this Website" means the online platform available at www.neoarcademachines.com.au.
"Terms and Conditions" refers to the guidelines and rules outlined in this agreement.
"User" denotes any individual who accesses or interacts with the Website in any capacity.
"Customer" signifies any person who purchases or orders products via this Website or in-store.
"Product(s)" refers to any goods displayed or available for purchase through the Website or at a physical location.
"Seller" identifies MEGA Gaming Pty Ltd operating as Neo Arcade Machines.

Introduction

The website neoarcademachines.com.au is operated by MEGA Gaming Pty Ltd, trading as Neo Arcade Machines (NAM). By using this Website and its Services, you agree to the Terms and Conditions stated herein. By registering as a user or making a purchase, you confirm that:

You have read and understood these Terms and Conditions.
You agree to comply with them while using the Website and related Services.

Consumer Guarantees

You may be eligible for remedies under Australian Consumer Law if a purchased item proves to be faulty. Change of mind does not affect your legal rights, and there is no specific time limit on these guarantees. However, timeframes may vary depending on the nature of the product or service, its price, and any statements made about it at the time of purchase.

Warranty Terms

Each product’s warranty details are available on its respective product page. Warranty coverage may differ depending on the type of product.

All warranties are "back to base" — you must return the defective item to Neo Arcade Machines at your own expense if an issue arises during the warranty period. Once received, we will repair or replace the product and return it to you at our cost.

If the issue is covered by warranty, we will either repair or, at our discretion, replace the product promptly. However, if the issue is due to misuse or abnormal use, we reserve the right to deny a refund, replacement, or repair. We may require proof of purchase before resolving any claim under consumer guarantees.

All warranty-related returns must be sent back to MEGA Gaming Pty Ltd unless an alternative arrangement is made between the customer and Neo Arcade Machines in advance.

Warranty Exclusions

The warranty does not apply in the following cases:

Improper Care: Proper maintenance is essential. If damage occurs due to neglect, misuse, or harsh cleaning agents (like abrasives or detergents), the warranty is void.
Accidents, Abuse, or Normal Wear and Tear: Any damage considered a result of daily wear, improper installation, abuse (scratches, dents, burns, etc.), outdoor placement, or natural disasters will not be covered.
Glass Table Tops: Any damage to the glass surface, such as chips or scratches, is not included in the warranty.
Subsequent Owners: Warranty applies only to the original purchaser and does not extend to future owners.
Commercial, Rental, or Institutional Use: The warranty does not cover usage in non-residential or commercial environments unless stated otherwise.
Floor Samples or Demonstration Units: Warranty excludes issues due to standard wear or disassembly of display models unless they are structurally defective.
Consumables: Items like buttons and joysticks are covered unless damaged through misuse or excessive force.
Damage During Transport: Any harm caused while shipping or handling by the customer or their agent is not covered.
Labour or Installation Costs: Charges related to service or installation in non-standard or industrial environments are not included in the warranty.
Manufacturer’s Discretion: MEGA Gaming Pty Ltd reserves the right to decide whether a part should be repaired or replaced under the warranty.

Terms and Conditions of Sale

By placing an order via this Website, in-store, or through phone/email, the Customer agrees to initiate a purchase. This action forms a legally binding agreement between the Customer and MECA GAMING Pty Ltd (trading as Arcade Machines Australia).

Once an order is submitted, stock will be reserved for the Customer for a period of three (3) days, unless extended by mutual agreement. It is the Customer’s responsibility to make payment within this period. If no payment is received, the reservation will expire, and the item will be made available to other buyers.

Inquiries alone do not secure stock. Reaching out for product details allows our team to assist, but does not guarantee product availability.

For out-of-stock items, an upfront payment of at least 50% of the total price is required to reserve a unit. This deposit is non-refundable. Full payment must be completed before dispatch or in-store collection.

Custom-built products require a 50% non-refundable deposit before production begins. These items are tailored specifically to each Customer’s order, and due to their custom nature, cancellation or change of mind is not permitted.

By proceeding with a custom order and placing the deposit, the Customer agrees to all conditions stated herein.

Please note: Estimated production timelines for custom builds range from 15 to 18 weeks after full payment is received. This timeframe is indicative only. MECA GAMING Pty Ltd will not be held accountable for external factors that may delay production or delivery. Every effort will be made to complete your build as quickly as possible.

Ordering Restricted Goods

“Restricted Goods” are items intended exclusively for individuals who meet certain legal age requirements, due to their content or classification.

The sale and distribution of Restricted Goods is governed by Commonwealth, State, and Territory legislation. By placing an order for such products, you confirm to MECA GAMING Pty Ltd that:

You are at least 18 years old when purchasing products classified as R18+.
You are at least 15 years old when purchasing products classified as MA15+.

You also warrant that you are not acting on behalf of any individual who does not meet the applicable age requirements for these products.

MECA GAMING Pty Ltd reserves the right to request proof of age in the form of official Commonwealth, State, or Territory-issued identification before fulfilling an order for Restricted Goods.

By placing an order online or in-store, you are making a formal offer to purchase goods or services. We reserve the right to accept or reject any order at our sole discretion.

Once your order is submitted online, you will receive a confirmation email with your order details and a payment receipt if applicable. Additional notifications may include:

Updates or inquiries regarding your order status;
Requests for payment verification;
Order acceptance or rejection confirmation;
Notification that your order is ready for pickup or has been dispatched.

Please note that even after receiving payment, we reserve the right to cancel, decline, or limit your order at any time and for any reason. If a cancellation occurs after your payment is processed, a full refund will be issued.

All prices are listed in Australian Dollars (AUD) and include GST. Neo Arcade Machines reserves the right to adjust pricing and product/service offerings at any time, for any reason, without prior notice.

Neo Arcade Machines reserves the right to accept, refuse, or restrict any orders in the event of website errors, including but not limited to incorrect pricing or inaccurate product specifications.

Any product availability details provided on the website are for reference purposes only and may change without prior notification. Neo Arcade Machines is not liable for any inconvenience or losses resulting from unavailable products ordered via the website.

Customers are solely responsible for providing accurate Billing and Shipping Addresses during checkout. Items will be delivered to the address entered by the customer; Neo Arcade Machines shall not be held liable for delivery issues or losses resulting from incorrect or incomplete shipping information.

Please allow 2–3 weeks for the delivery of spare parts and website-purchased items, as many products are shipped directly from our factory in China.

Freight Options

It is the customer's responsibility to select a suitable freight method during checkout. Neo Arcade Machines will not be liable for any delays, issues, or additional charges resulting from an inappropriate freight selection for the order's circumstances.

No items will be dispatched until full payment has been confirmed by the customer. Neo Arcade Machines will not ship any product before payment is cleared. Any delivery dates provided are estimates only and do not form part of a binding agreement.

We aim to dispatch goods promptly; however, delays may occur due to unforeseen events beyond our control. Neo Arcade Machines accepts no responsibility for such delays. For custom orders, please allow 5–6 weeks for production and shipping.

To comply with OH&S (Occupational Health & Safety) standards, customers must be present to assist at the point of delivery. Extra charges may apply if a two-person delivery or tailgate truck is required.
